ChessPredator Terms of Service

These Terms are an agreement between you and the operator of ChessPredator ("ChessPredator", "we", "us"), and cover your use of chesspredator.com and its services (the "Service"). Our Privacy Policy explains how we handle personal data.

Please note: section 12 requires most disputes to be resolved by individual arbitration and waives class actions. You can opt out within 30 days.

1. Agreement and eligibility

By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

You must be at least 13 to create an account. If you are under 18, you need a parent's or guardian's permission to buy a paid plan, and they accept these Terms for you.

2. Your account

  • Give accurate information and keep it current.
  • Keep your password and sign-in methods safe. You are responsible for what happens in your account. If you think someone else has used it, tell us at chesspredatorapp@gmail.com.
  • One person per account. Don't share or transfer your account.
  • You may link chess profiles that belong to you, and follow other players' public profiles to analyze them.

3. The service

ChessPredator analyzes chess games that are publicly available on Lichess and Chess.com. It uses the Stockfish engine and other statistical and AI tools to show opening performance, error patterns, opponent preparation, written player reports, and "digital twins" you can play against.

The Service is in early access. Features may change, be added or be removed, and it may sometimes be unavailable. We will try to give notice of changes that take away something you paid for (see section 8).

4. Fair play

Never use ChessPredator during a game that is in progress, online or over the board. That covers analysis, reports, the explorer, twins, and any other feature.

Preparing before a game is fine. Studying an opponent's openings and habits before you sit down is a normal part of chess, and it is what the Service is for.

Getting help during a game breaks the fair-play rules of Lichess (Fair Play), Chess.com (Fair Play Policy) and FIDE (Laws of Chess, Article 11.3), as well as most tournament rules. We may suspend or close accounts that we reasonably believe were used this way. Your account on those platforms is governed by their rules, not ours.

5. Acceptable use

Don't:

  • scrape, crawl or bulk-download the Service or its data, or use automated tools to access it, except the public pages that search engines index under our robots.txt;
  • copy, decompile or reverse-engineer the Service, or try to get around its security;
  • use player pages or analysis to harass, stalk, threaten or intimidate anyone;
  • use a digital twin, or anything else from the Service, to pretend to be a real player or to suggest that a player said or did something;
  • resell, rent or sublicense the Service, or present its output as your own commercial product;
  • get around credit limits, rate limits or plan restrictions, for example by opening several accounts;
  • break the law, or other people's rights, while using the Service.

6. Lichess, Chess.com and other third parties

ChessPredator is independent. We are not affiliated with, endorsed by or sponsored by Lichess, Chess.com, FIDE or the Stockfish project. Their names identify the sources of data and the tools we use.

When you connect a Lichess account or use Google Sign-In, those services' own terms apply to your accounts with them. We are not responsible for outages or changes at those services that affect the Service.

7. AI-generated content, analysis and twins

Reports are generated with AI, and analysis comes from engine evaluations and statistics. Both can be wrong or incomplete. Results are probabilities, not predictions of what a player will do.

Everything the Service produces is for training and entertainment. It is not a statement of fact about any real person's ability, character or conduct, and must not be used as evidence that anyone cheated.

A digital twin is a statistical model trained on a player's public games. It is not the player, doesn't speak for them, and isn't endorsed by them. Players can have their public page and twin removed (see our Privacy Policy).

8. Paid plans, credits and billing

Plans and credits. Plans and prices are listed at /pricing. Every plan, free and paid, includes a monthly allowance of analysis credits. Each analysis uses credits as shown before you start it. Credits:

  • reset on the first day of each month;
  • have no cash value, and can't be sold, transferred or exchanged for money;
  • don't roll over: unused credits expire at the reset.

We may change how many credits a feature uses. Before you confirm an analysis, you will always see what it costs.

Billing. Payments are processed by Stripe. Card details go straight to Stripe and never reach our servers. Prices do not include taxes. Where the law requires, tax is added at checkout, and you see the total before you pay.

Automatic renewal. Paid plans renew automatically at the end of each billing period (monthly) and are charged to your payment method at the price then in effect until you cancel. Before you buy, the checkout page shows the price, how often you will be charged, that the plan renews automatically, and how to cancel. You must agree to these terms before we charge you. We email you a confirmation that repeats them.

Cancelling. Cancel at any time, online, with the Cancel plan button in Settings, in as few steps as it took to sign up. No email, phone call or chat is needed. When you cancel, you keep your plan until the end of the period you paid for, and it does not renew.

Money-back guarantee. If you are not happy, ask for a full refund within 30 days of your first purchase. This applies to your account's first paid purchase. It is our own policy, offered voluntarily. Email chesspredatorapp@gmail.com with "Refund" in the subject. After that window, we don't refund partial periods or unused credits, except where the law requires us to.

If you are a consumer in the EU or UK: you have a legal right to withdraw from a contract within 14 days of buying, without giving a reason. Our 30-day money-back guarantee already covers this. To withdraw, send us a clear statement (for example, by email to chesspredatorapp@gmail.com) before the period ends. We will refund you within 14 days, using the original payment method.

Price changes. We will tell you about a price change by email at least 30 days before it applies to you, and it will take effect only at your next renewal. If you don't want the new price, cancel before then.

Free plan. The free plan has limited features and credits, which we may change.

9. Intellectual property

Ours. The Service belongs to us and our licensors: the software, design, models, the analyses as we compile and present them, and the ChessPredator name and logo. We give you a personal, non-transferable, revocable permission to use the Service for your own chess study, under these Terms. You may share individual reports and screenshots for non-commercial purposes.

The games. The moves of a chess game are facts, and in our view no one owns them, including us. Other material that comes with games or profiles, such as avatars, belongs to its owners.

Third-party licences. Some components are used under their own licences, for example the board pieces (CC BY-SA 3.0, credited in the site footer) and the Stockfish engine (GPL).

Feedback. If you send us ideas or suggestions, we may use them without owing you anything.

10. Suspension and termination

You may stop using the Service and delete your account at any time by emailing chesspredatorapp@gmail.com from the address on your account. We delete it within 30 days.

We may suspend or close your account if you seriously or repeatedly break these Terms, especially the fair-play and acceptable-use rules, or if the law requires it. Where possible, we will tell you why and give you a chance to respond. If we close a paid account without good cause, we refund the unused part of the period you paid for.

When an account closes, we handle its data as our Privacy Policy describes. Sections 7, 9, 11, 12 and 14 survive termination.

We may end the Service entirely with at least 30 days' notice, and refund unused prepaid periods.

11. Disclaimers, liability and indemnity

Disclaimer. The Service is provided "as is" and "as available". To the extent the law allows, we make no warranty that the Service will be uninterrupted or error-free, or that any analysis, evaluation, report or twin is accurate or fit for a particular purpose.

Limitation of liability. To the extent the law allows:

  • we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, games or rating points;
  • our total liability for all claims about the Service is limited to the greater of what you paid us in the 12 months before the claim, or US$50.

Nothing in these Terms limits liability that the law does not allow to be limited, such as liability for fraud, gross negligence, or death or personal injury caused by negligence. If you are a consumer in the EU or UK, these limits do not affect your mandatory statutory rights.

Indemnity. If you misuse the Service or break these Terms and a third party makes a claim against us because of it, you will cover our reasonable costs of that claim. This does not apply to EU or UK consumers, except as their law allows.

12. Disputes and governing law

Try us first. Before starting any formal claim, email chesspredatorapp@gmail.com with a short description of the problem and what you want. We both agree to try to resolve it informally for 30 days.

Governing law. These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-laws rules.

Small claims. Either of us may bring an individual claim in a small-claims court that has jurisdiction.

Individual arbitration. Any dispute not resolved informally or in small-claims court will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Sacramento County, California, or by video, at your choice. We will pay the filing and arbitrator fees beyond those you would pay to file in court.

No class actions. You and we each waive the right to a jury trial and to take part in a class action or class arbitration. Each claim is brought individually.

Public injunctive relief. Where a law such as California's (McGill v. Citibank, 2017) does not allow the right to seek public injunctive relief to be waived, a claim for it will be heard in court, after any individual arbitration ends.

Opting out. You can opt out of arbitration by emailing chesspredatorapp@gmail.com within 30 days of first accepting these Terms, with "Arbitration opt-out" in the subject. Opting out doesn't affect anything else in these Terms.

Courts. Any dispute that goes to court — because you opted out, because a claim falls outside arbitration, or because the class-action waiver is found unenforceable for that claim — will be decided only by the state or federal courts located in Sacramento County, California (including the U.S. District Court for the Eastern District of California), and you and we consent to their jurisdiction.

EU and UK consumers. If you are a consumer living in the EU or UK, you keep the protection of the mandatory laws of your country, and you can bring a claim in your local courts.

13. Copyright complaints

If you believe material on the Service infringes your copyright, send a notice under the U.S. Digital Millennium Copyright Act by email to chesspredatorapp@gmail.com, with "DMCA notice" in the subject. The notice must include the elements required by 17 U.S.C. §512(c)(3). We may close the accounts of repeat infringers.

14. General terms

  • Changes. We may update these Terms. For material changes, we tell you by email or with a notice on the site at least 14 days before they take effect. If you keep using the Service after that, you accept the new Terms. If you don't accept, you can cancel and delete your account. Changes do not apply to disputes that started before them.
  • Entire agreement. These Terms, the Privacy Policy and any checkout terms you accept are the whole agreement between us about the Service.
  • Severability. If any part of these Terms can't be enforced, the rest still applies.
  • Assignment. You can't transfer these Terms. We may transfer them as part of a merger, acquisition or sale of the Service, and will tell you if we do.
  • No waiver. If we don't enforce a term right away, we can still enforce it later.
